About these terms

These terms apply when you browse or place an order through vibragear.com. The seller is Vibragear, an independently operated UK online retailer. Vibragear is a trading name and is not a limited company.

Nothing in these terms limits any rights you have under applicable consumer law.

Placing an order

When you place an order, you are offering to buy the selected products. An automated acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it. A contract is formed when we send confirmation that the order has been accepted or dispatched.

We may decline or cancel an order before dispatch if a product is unavailable, payment cannot be authorised, the information supplied is incomplete or incorrect, or we reasonably suspect fraud or misuse. If payment has already been taken, it will be refunded.

Products and sizing

We aim to describe and display every product accurately. Colours may vary slightly between screens and finished products. Please check the product description and size guide before ordering.

Most products are made to order by our fulfilment partners. This reduces unnecessary stock but means fulfilment begins shortly after an order is accepted.

Prices, payment and taxes

Prices are shown in the currency displayed at checkout. The total price, delivery charge and any applicable taxes will be shown before you place the order. Payment is processed by the payment provider selected at checkout. Vibragear does not receive or store your complete card details.

Customers receiving orders outside the country of fulfilment may be responsible for import duties, taxes or customs charges imposed by their local authority. Where we know about a charge in advance, we will show it during checkout.

Delivery

Delivery estimates are provided in good faith and are not guaranteed dates. Unless a different period is agreed with you, goods will be delivered without undue delay and within 30 days after the contract is made. If we cannot meet an agreed deadline, your legal remedies remain available.

Some items may arrive separately. Risk passes to you when the goods are delivered to you or to a person you have nominated, unless you independently arranged a carrier that we did not offer.

Your right to cancel

If you are a UK consumer buying at a distance, you will usually have 14 days from the day after receiving the goods to tell us that you wish to cancel. You then have a further 14 days to return them. Similar or additional rights may apply where you live.

The cancellation right does not apply to goods made to your specifications or clearly personalised. A product is not treated as personalised merely because it is produced after an order is placed.

To cancel, email returns@vibragear.com with your name, order number and a clear statement that you wish to cancel. You may use the model cancellation wording at the end of these terms, but you do not have to.

Unless the goods are faulty, damaged or incorrectly supplied, you are responsible for the direct cost of returning them. You must take reasonable care of the goods. We may reduce a refund to reflect loss in value caused by handling beyond what would reasonably be permitted in a shop.

We will refund the price paid and the cost of our least expensive standard delivery option. A refund will be made within 14 days after we receive the returned goods or evidence that they have been sent back, whichever is earlier. We may withhold the refund until then.

Faulty, damaged or incorrect goods

Goods must be as described, fit for purpose and of satisfactory quality. Your legal remedies may include a refund, repair or replacement. These rights are separate from the cancellation right and are not limited by our returns procedure or by any short reporting deadline.

Please contact returns@vibragear.com as soon as reasonably possible with your order number, a description of the problem and helpful photographs. We will provide the correct return instructions. We will cover reasonable return costs where goods are faulty, damaged or incorrectly supplied.

Returns

Do not send a return to an address on an old parcel without contacting us first. Our fulfilment partners use several return locations, and we need to provide the correct address for your order. Requiring contact first does not remove or delay your statutory rights.

Intellectual property

The website, branding, photographs, graphics and written content are owned by Vibragear or used with permission. They may not be copied, republished or commercially exploited without permission, except where the law allows.

Our responsibility

We do not exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a consumer purchase. If you use products for business purposes, different rights may apply.

Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control. We will contact you when reasonably possible and take practical steps to minimise the effect. Your right to cancel where the delay is substantial remains unaffected.

Complaints

Email complaints to hello@vibragear.com. Please include your order number and enough information for us to investigate. We aim to acknowledge complaints promptly and deal with them fairly.

Governing law

These terms are governed by the law of England and Wales. If you are a consumer elsewhere, you retain any mandatory protections provided by the law of your home country. You may bring proceedings in the courts that have jurisdiction under applicable consumer law.

Changes to these terms

We may update these terms from time to time. The terms in force when your order was placed will apply to that order.
